Forms of Custody

In a child custody dispute, two forms of custody must be decided: physical and legal. Either form of custody can be joint, meaning both parents share custody, or sole, where one parent is awarded full custody.

Physical custody has to do with where the child lives and which parent cares for them. A joint physical custody arrangement might involve the child splitting time with the parents 50/50. However, the court may decide that such a routine would be disruptive for the child; an alternate arrangement might have the child spending every other weekend and certain holidays with one parent while spending the majority of his or her time with the other.

Legal Custody refers to the decision-making rights and responsibilities of the parents. A parent with sole legal custody can decide where a child goes to school, what medical care providers to see, and even the religion in which the child will be raised. In a joint legal custody arrangement, both parents have input on these decisions.

The court will allow a custody arrangement to which both parents agree, unless they believe it is not in the child’s best interest.
